 issue resolved at apache and fix merged to 5.4.1 branch. Available to validate via snapshot:
http://repo.fusesource.com/nexus/content/repositories/snapshots/org/apache/activemq/apache-activemq/5.4.1-fuse-SNAPSHOT/ There is still an issue here that the user demonstrated in a new test case (durablesub-test-2.zip on DEV-2707).
There has been another test added to this issue. Please find all in durablesub-test-3.zip on DEV-2707.
thanks for the tests, have got to the bottom of variant2 but there is still a problem with variant3 of the test.
fixes merged and new snapshot deployed, additional testing started in parallel. If all is good, this should be sorted.

at apache, found the problem and reduced it to a simple test. Will complete the fix to day and build a snapshot. new snapshot with fix: https://issues.apache.org/jira/browse/AMQ-3190
